1. About these terms
These Terms of Service ("Terms") govern your use of MotoHist as an owner of a motorcycle or other vehicle ("you" or "Owner"). MotoHist is operated by Vellora Ops Ltd(trading as MotoHist), registered in Scotland, whose registered address is Office 110, 18 Young Street, Unit LGE, Edinburgh, EH2 4JB ("we", "us", or "Vellora Ops Ltd").
By creating an account or using MotoHist you agree to be bound by these Terms. If you do not agree, you must not use the service.
2. The service
MotoHist provides a platform for motorcycle owners to:
- Store and manage verified service history records for their vehicles.
- Transfer vehicle ownership and associated records to a new owner.
- Share a verifiable, redacted history check with prospective buyers.
- Book servicing appointments with verified garages listed on the platform.
- Participate in a community of riders through posts, comments, and groups.
We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice where practicable.
3. Eligibility and your account
You must be at least 18 years old to use MotoHist. By creating an account you confirm that the information you provide is accurate and that you are the lawful owner or keeper of any vehicle you register.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
4. Vehicle records and stamped history
You may register vehicles and add service records to your account. Records that have been stamped by a verified garage are permanently sealed. This means:
- A stamped record cannot be edited, deleted, or disputed through the platform by you or any other party after the garage has applied their stamp.
- If you believe a stamped record is incorrect, you must resolve the dispute directly with the garage concerned. You may also contact us to flag a potential fraudulent stamp.
- Personal maintenance notes you add yourself (quick-entry records) may be edited or deleted by you at any time. These records are not eligible for garage stamping and do not carry verified status.
- Records produced by a self-service guided session are also not eligible for garage stamping. They may be edited until the session is submitted as complete, after which they are locked and cannot be modified or deleted.
MotoHist does not independently verify manually entered records. We do not warrant or represent the accuracy of any service history data.
5. Ownership transfers
When you transfer ownership of a vehicle through MotoHist, the vehicle record and its associated service history are transferred to the new owner. After transfer:
- You will no longer have access to the vehicle's records.
- Your personal data is not passed to the new owner - ownership counts are disclosed to history check recipients as a number only.
- Transfers are permanent and cannot be reversed through the platform once completed.
6. Bookings
MotoHist facilitates the booking of servicing appointments between you and independent garages. We are not a party to the service contract between you and the garage. Any dispute regarding the quality of work, pricing, or conduct of a booking must be resolved directly with the garage.
By submitting a booking you consent to the relevant garage being able to view the booking details and the associated vehicle information for the purposes of fulfilling the appointment.
7. Community conduct
When participating in the MotoHist community you agree not to post content that is:
- Illegal, defamatory, harassing, or threatening.
- Hateful or discriminatory on the basis of any protected characteristic.
- Spam, unsolicited advertising, or misinformation.
- An infringement of any third party's intellectual property rights.
We reserve the right to remove content and suspend or terminate accounts that violate these standards, with or without notice, at our sole discretion.
8. Intellectual property
All platform software, design, and branding is owned by or licensed to Vellora Ops Ltd. You retain ownership of any original content you post (e.g. photos, post text) but grant us a non-exclusive, royalty-free licence to display and distribute that content within the platform.
9. Disclaimers and limitation of liability
The service is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or that data will not be lost, although we take reasonable steps to maintain availability and security.
To the fullest extent permitted by law, Vellora Ops Ltd's total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded by law.
10. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms, if you are inactive for more than 3 years, or if we decide to discontinue the service.
Upon termination, stamped service records will be disassociated from your identity but will not be deleted, as described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of Scotland. Any dispute shall be subject to the exclusive jurisdiction of the Scottish courts, except where mandatory consumer protection laws in your country of residence provide otherwise.
